Is the salary cap illegal?

    No salary cap would ruin the game. Only a few teams would compete each year. Crowd figures in Sydney would be lucky to hit a thousand.

    I have not looked into the issue too much but my understanding is that it could very well be overturned in Court. Then it comes down to who wants to bring it down? Whoever takes it on has to have access to funding to cover the ongoing legal costs.

    Will it be the clubs? Probably not as they have a set salary that they know they have to pay and every other club has to pay so as long as they get grants ect then they will be sustainable especially the smaller clubs. The more successful clubs like the Broncos are likely to be happy as they have a pretty large area to scout players from and are profitable without having the best lineup. If the cap was removed they would have to spend big and the returns to investors from having a better team would not likely improve enough to to cover the increased spending. Clubs are also cautious that removing the cap could leave only a select number of teams competing each year for the trophy and thus could actually damage the league and sport in general.

    Then there is the players. Most players probably never have even considered this issue so would never contemplate tackling it. They just do their job each week. I don't think one player would ever contest it due to the time and money that would be required which means a collective group would be required. Ideally this would need to be pushed by the big earners in the game who have enough influence to get support by all the players. Overall the top 50 players may support it as they may benefit but all the players outside this probably would not as they would get a lesser slice of the pie as those clubs that are financially struggling that have a limit based on their revenue would need to pay less overall to those players. To compete with the big clubs they need to pay massive money for the stars leaving less for the rest. Under the current model they would probably get more. The players outside the top 25 for each squad would be potentially for it but they don't likely have any influence or money to initiate it.

    The administrators are going to do what they think is in the best interest of the sport. They have invested so much into getting the salary cap in place whether it is right or wrong and now to undo it would be a huge cost to the sport and the uncertainty of how it would play out would be considered to high risked.

    Personally I don't like the idea of the cap and I think over time it would improve the sport to remove it and have a regulation model in place instead forcing clubs to be sustainable on their own and to make good economic decisions to ensure their survival. It is just a question of who will tackle the issue. As long as people keep discussing the issue and it gets media attention the issue will get more interest.

    You say the players are unlikely to challenge it, but that's exactly what happened in European Football with the Bosman Ruling. I mean, a very different circumstance but if a player feels sufficiently hard done by - such as not being able to attract a contract the size of which he feels he deserves due to the salary cap - then a sufficiently wealthy player could challenge the cap.
